UNIONDALE, N.Y. (CBS 2) — He was arrested for protecting his property and family.

But it’s how the Long Island man did it that police say crossed the line.

He got an AK-47 assault rifle, pulled the trigger and he ended up in jail, reports CBS 2’s Pablo Guzman.

George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home.

“I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said.

Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house.

“He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said.

Grier was later arrested. John Lewis is Grier’s attorney.

“What he’s initially charged with – A D felony reckless endangerment — requires a depraved indifference to human life, creating a risk that someone’s going to die. Shooting into a lawn doesn’t create a risk of anybody dying,” Lewis said.

Grier said he knew Nassau County Police employ the hi-tech “ShotSpotter” technology in his area and that the shooting would bring police in minutes. Cops told Guzman he was very cooperative.

Grier also said he was afraid the gang outside his house was the dreaded MS-13. And Nassau County Police Lt. Andrew Mulraine, head of the gang unit, said MS-13 has 2,000 members in the county.

“They’re probably the most organized. They almost have a military hierarchy within the gang, so they are the most organized gang we encounter on a daily basis,” Mulraine said.

You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun.

Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

That ShotSpotter technology pinpoints where a gun has been fired within 35 feet. Police said it also detected two other shootings in nearby Roosevelt that night.

I copied the whole text of the article here because I don't know how long CBS2 will keep it available on their site, and it needs to be seen. The many comments against the police and in favor of Mr. Grier are also worth seeing. I didn't read one that said he was wrong.

it is so F**king unbelievable that the police arrested mister Grier for trying to defend his family. Police determined that he had the gun legally, which means it was a legal semi-automatic weapon (Not an assault rifle) and he was legally eligible (not a criminal, doper, violence-prone, etc) to possess it.

The two dozen or more people who gathered on his lawn threatening to kill him and his family probably were members of the ultra-violent MS-13 gang, originally from El Salvador, but Long Island is one area where they are concentrated. Even if the police pull their heads out of their asses and exonerate mister Grier, he is going to have to move and hope the gang doesn't track him down.

All of the illegal aliens crossing our borders are not lawn-mowers and maids. Some of them are MS-13 looking for richer targets than they can find in Latin America, some of them are Islamic terrorists getting in place for the next 9/11. Our government is not only ignoring the influx, they are doing everything possible to facilitate it.

At the same time the government is doing everything it can to disarm the American citizens. Last week the Environmental Protection Agency tried to ban lead in bullets. A blatant move to disable every gun in America by taking away ammunition. There have been dozens of failed anti-gun bills introduced into congress in the last two years. Our congress may be corrupt and inept but they know the surest way to unemployment is to support an anti-gun bill.

But we have to watch the government like a hawk for edicts and executive actions and backdoor maneuvers like the EPA move. They'll keep trying to disarm the "good-guys". Governments know that it works. It worked for Hitler, and Mussolini and Pol Pot and...

I live in Texas. I have a Concealed Handgun License. I am an expert marksman. I fear no evil for I am capable of rending its brain with a hollow point bullet. Next week I will be visiting relatives in Massachusetts. There have been violent burglaries in the neighborhood recently, people were stabbed in their beds. To get a license to just possess a gun in your home in Massachusetts, you need a letter from the Pope, endorsed by Osama Bin Laden, and the commander of the state police (Gestapo, in German) must approve of your bloodline. Possession of a weapon without said license requires a one year automatic prison sentence, no questions, no argument, do not pass go.

I hope my old "Louisville Slugger" is still in a closet somewhere up there.
